These Terms of Service govern your use of the websites, patient portals, and messaging programs operated by Precipio, Inc., operating as Precipio Diagnostics (“Precipio,” “we,” “us”). By using these services, you agree to these terms. If you do not agree, do not use the services.

Use of our services

You agree to use Precipio’s websites, portals, and messaging programs only for lawful purposes and only as permitted by these terms. You may not attempt to gain unauthorized access to any system, interfere with the operation of our services, or use them to transmit unlawful, harmful, or misleading content.

Not medical advice

Information provided through our websites and programs is for general informational and scheduling purposes. It does not constitute medical advice, diagnosis, or treatment, and does not replace consultation with a qualified healthcare provider. Always seek the advice of your physician or other qualified provider with questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on our sites or receive in a message from us.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not use text messaging to report an emergency.

Accounts and access

Some services require an account. You are responsible for keeping your credentials confidential and for activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate access to any account that we reasonably believe has been compromised or used in violation of these terms.

Text messaging terms

These terms apply to Precipio’s text messaging programs, including messaging for the Serene virtual reality wellness program. Full program details are available at serene.precipiodx.com/sms.

Enrollment and consent

You are enrolled in a Precipio text messaging program only if you have affirmatively opted in — by checking the SMS consent box during online enrollment, by initialing the text messaging section of a paper enrollment form, or by texting START to a Precipio number. Precipio does not send messages to numbers that have not opted in, and does not purchase or import phone numbers from third parties.

Message content and frequency

Messages are transactional and relate to your enrolled program. Depending on the program, they may include scheduling confirmations, appointment reminders, session access links, equipment pickup and return notices, and service notifications such as schedule changes. Precipio does not send marketing or promotional content through these programs, and does not send messages on behalf of third parties.

Message frequency varies based on your schedule and activity. Most participants receive fewer than five messages per month.

Cost

Message and data rates may apply. Precipio does not charge for text messages. Charges from your mobile carrier depend on your plan and are your responsibility. Contact your carrier for details about your plan.

Opting out

Reply STOP to any message to opt out. You will receive a single confirmation message, after which no further messages will be sent to that number. To opt back in, reply START or ask a Precipio staff member to re-enroll your number.

Carriers and delivery

Supported carriers include AT&T, Verizon Wireless, T-Mobile, and other major U.S. carriers. Carrier support may change without notice. Carriers are not liable for delayed or undelivered messages. Precipio does not guarantee that any message will be delivered, and delivery may be affected by your device, carrier, network conditions, or plan.

Your phone number

You agree to notify Precipio if you change or give up the mobile number you enrolled. You represent that you are the subscriber or customary user of the number you provide and are authorized to consent to receive messages at that number.

Privacy

Mobile phone numbers and SMS consent are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

Intellectual property

All content on Precipio’s websites and in our programs — including text, graphics, logos, software, and the Precipio and Serene names and marks — is owned by Precipio or its licensors and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without our prior written permission.

Disclaimers

Our websites, portals, and messaging programs are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Precipio disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Precipio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of our websites, portals, or messaging programs — including any failure, delay, or non-delivery of a text message. This limitation applies regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.

Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. Any dispute arising under these terms will be brought in the state or federal courts located in Connecticut.

Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with a revised effective date. Continued use of our services after an update constitutes acceptance of the revised terms.
